Op woensdag 25 mei keken 130 Belgische boeren raar op van een brief die hen aanmaande om kwekersrechten te betalen op hoevepootgoed van enkele aardappelrassen.
Eerder dit jaar daagde de afzender van die brieven, de organisatie Breeders Trust, het Voedselagentschap voor de rechter wegens het niet vrijgeven van gegevens van telers van hoevepootgoed. Breeders Trust verenigt acht Noord-Europese pootgoedfirma’s die een vuist wensen te maken tegen de “illegale” vermeerdering van pootgoed.
“Op kwekersrechtelijk beschermde aardappelrassen zijn immers licenties verschuldigd”, legt de directeur van de organisatie, Geert Staring, uit. “Ook in afwachting van het vernieuwde Belgische kwekersrecht is dat het geval”, treedt specialist in intellectueel eigendomsrecht Philippe de Jong van het advocatenkantoor ALTIUS zijn cliënt bij.
Uiteindelijk kwam het tot een akkoord tussen Breeders Trust en de landbouworganisaties. Tegelijk werd de intentie geuit om de inning van kwekersrechten interprofessioneel te regelen tegen 2012. VILT kruipt in de huid van een aardappelteler die wil weten waarom hij kwekersrechten verschuldigd is.
